HAPPENING NOW! FG Directs Osun State Governor Adeleke to Suspend Local Government Elections
The Nigerian government, led by President Bola Tinubu, has directed Osun State Governor Ademola Adeleke to suspend the local government elections scheduled for Saturday. The directive follows the ongoing political crisis in the state, DAILY GIST reports.
The Attorney-General of the Federation (AGF) made the request in a statement, emphasizing that the position of the law was clear regarding the conflict between the All Progressives Congress (APC) and the Peoples Democratic Party (PDP).
The situation escalated earlier in the week when a clash broke out between supporters of the council chairman, leading to injuries for several individuals.
The Osun State government has blamed the crisis on the APC and former governor Gboyega Oyetola, who is now the Minister of Marine and Blue Economy.
In a statement on Thursday, the federal government argued that the order upon which Governor Adeleke relied to sack the local government administration had already been rejected by the court.
Referring to the judgment of the Court of Appeal, Akure Division, delivered on February 10, 2025, in Appeal No. CA/AK/272/2022, as well as the Federal High Court ruling in Osogbo, Osun State, on November 25, 2022, the AGF clarified that the legal position was now settled.
The statement noted:
"It has become necessary to issue this public notice to remove doubts, fears, and uncertainties regarding the representations and misinformation about the Court of Appeal's ruling."
"To put matters in proper context, the events that led to these two judgments began during the tenure of former Governor Gboyega Oyetola. Local government elections were conducted, and winners were sworn in."
"However, a few days before Governor Adeleke's swearing-in, the Federal High Court in Osogbo ruled against the election, which led to the removal of the elected local government officials."
"Upon assuming office, Governor Adeleke issued an executive order removing the elected officials and replacing them with caretaker committees."
"The Federal High Court ruling was appealed, and on February 10, 2025, the Court of Appeal determined that the original judgment by the Federal High Court was incompetent and subsequently struck out the suit."
The federal government further stated that, according to the law, the elected local government officials had regained their positions and would continue their tenure until October 2025.
"Given this legal standing, any local government election scheduled for February 22, 2025, would not only be invalid but also constitute a breach of the Constitution."
The statement urged Governor Adeleke to reconsider proceeding with the planned election and to adhere to the rule of law to ensure a smooth transition at the end of the statutory three-year tenure for local government officials.
